Litigation

Our firm has successfully litigated construction disputes involving a wide variety of real estate disputes including purchase and sale contracts, issues that commonly arise during the development/construction process, construction lien rights, design, engineering and construction defects, foreclosures and work-outs, real estate financing, brokerage commission disputes, board licensing, tax assessments and appeals and partnership and joint venture agreements.

Our strength in real estate litigation is our understanding of contract law, our ability to devise and implement creative strategies and our experience and familiarity with technical construction/development issues.

To this end, we seek to resolve our clients' disputes not only by litigation, but through pre-litigation negotiation and by the use of alternative dispute resolution processes (such as nonbinding facilitation and binding arbitration).

Transactions

For example, we have assisted clients in the structuring of transactions and ownership interests, acquisition and disposition of properties and interests therein, development, leasing of real property, and assistance in obtaining construction and long-term financing and distressed property work-outs.
